Technical support subscription coverage will begin the 1st of the following month to the last day of the current month. *Customers who have a technical support subscription must maintain their monthly premium to continue to receive unlimited services for no additional charge. *Customer therefore authorizes Omtat Corporation to automatically charge their credit cards for the monthly subscription service charge signed up for accordingly. If the customer would like to make any changes to their payment arrangements please contact Omtat Corporation customer service department. Your subscription covers: Gauge Overall PC Health-Diagnose your computer and make it safe and secure Tune up the System-Check settings to help your computer run faster Eliminate Threats-Remove viruses, malware, and other bad things, Network Protection- Ensure your networks are safe, Ongoing Monitoring Checks your computer for active anti-virus and other problems, Connected Device Support- Connect your devices (printers, wireless networks, cameras, Education and Training- Training help on how to do stuff that seems confusing, Software Installation Software Assessment and removal of viruses and malware - 3 Plan Options: https://omtatcorporation.com/technical-support Service is on a per-customer basis and is limited to selected devices, and PC/Laptop owned by the customer. The fee for the Service is a set fee without regard to usage (i.e., once the Customer has purchased the Service, there will be no refund of the fee even if the Customer does not use the Service thereafter). Customer must purchase the Service in one-year increments, unless approved via Management. There is a onetime setup fee of $100 per subscription; this fee covers the configuration of the clients PC to our remote service network for all future services; Training and training services are not included in the Service, but are available at Omtat Corporation standard service rate. If Omtat Corporation is unable to successfully complete one of the services set forth above by logging-in remotely to the Customer’s computer, Customer may purchase a Omtat Corporation in-home service to address the issue at the regular service price. Pre-requisites Customer pre-requisites: The Service requires a functioning high-speed Internet connection, and up-to-date antivirus software installed on the PCs. If Customer signs up for automatic renewal, his or her subscription will renew automatically at the end of each 12 month period, unless otherwise noted. Omtat Corporation may terminate the subscription at anytime or Customer may notify Omtat Corporation of his or her decision to terminate the subscription. Omtat Corporation will bill all charges automatically to Customer’s credit card at the beginning of every renewal period, at the rates then in effect, unless Customer notifies Omtat Corporation otherwise. Omtat Corporation will notify Customer of the pending subscription renewal at least 30 days prior to the date the subscription is scheduled to renew, except as otherwise required by law. Customer must cancel his or her subscription before it renews in order to avoid billing of subscription fees for the renewal term to his or her credit card. Subscriptions are non-refundable after purchase. Subscriptions are automatically charged every month to clients credit/debit cards. If Omtat Corporation is unable to deduct funds from clients account, subscription will suspended until payment is received. Non-payment after 2 months will lead to subscription being canceled. Once subscription is canceled, client will have to open a new subscription account. In-home service fee covers only the agents transport cost and the diagnostics of your pc, it does not cover the cost of the actual service needed ie, (Virus removal, PC optimization, software install, etc.)

This purchase is governed by the following general terms of sale for consumer purchases of goods over the Internet. Consumer purchases via the Internet are mainly governed by the Contract Act, the Consumer Purchase Act, the Marketing Act, the Business Act and the e-commerce Act, and these laws give the consumer substantial rights.
The agreement is also supplemented by relevant legal provisions governing the purchase of goods between traders and consumers. The seller is: Omtat Corporation;
The buyer is the consumer who places the order and hereinafter referred to as the buyer. The price quoted for the goods and services is the total price to be paid by the buyer. This price includes all fees and additional costs, minus shipping if applicable. The agreement is binding on both parties once the buyer has sent their order to the seller. When paying with an invoice, the invoice is issued to the buyer upon shipment of the item. The payment deadline is stated on the invoice and is at least 14 days after receipt.
Buyers under 18 cannot pay with subsequent invoice (We do not currently offer payment via invoice). Delivery takes place when the buyer or his representative has taken over the item (serial code for the software). All our products are delivered digitally in the form of a product key for the product. Most product keys are delivered automatically and can be picked up immediately after purchase. Redemption deadline for product keys
Certain product keys may have a redemption deadline, so we encourage you to redeem your product keys within 1 month of purchase. Hence, you cannot claim compensation for a product key that is more than 1 month old from the purchase date and has not yet been redeemed. As soon as a product key is redeemed, it will not have any expiration date other than described for the individual product.
If the seller fails to deliver the product (product key) at the time of delivery, the buyer must urge the seller to deliver within a reasonable additional period of fulfillment. If the seller fails to deliver the goods within the extra time, the buyer can cancel the purchase.
However, the buyer can cancel the purchase immediately if the seller refuses to deliver the item. The same applies if delivery at the agreed time was crucial to the conclusion of the agreement or if the buyer has informed the seller that the delivery time is crucial.
If the item (product key) is delivered after the additional deadline set by the consumer or after the delivery date that was crucial to the conclusion of the agreement, cancellation claims must be made within a reasonable time after the buyer was notified of the delivery.

Shipping cost will be estimated based on the weight of the item and the location for delivery. All sales are final, unless the item arrives damaged or not as described. IT'STHE CUSTOMER’S RESPONSIBILITY TO BACK-UP DATA. Customer agrees that prior to Omtat Corporation servicing any Customer equipment it is Customer’s responsibility to (1) back-up the data, software, information or other files stored on Customer’s computer disk drives, peripherals, MP3 player, DVD player, camcorder, digital camera and/or on any other electronic storage device; and (2) remove all videotapes, compact disks, floppy disks, laser disks, cassettes, DVDs, film or other media from Customer’s product. Customer agrees that whether or not Customer requests back-up services from Omtat Corporation and/or its third party service provider, neither Omtat Corporation, nor its third party service provider shall be liable under any circumstances for any loss, disclosure, alteration or corruption of any data, software, information, files, videotapes, compact disks, floppy disks, laser disks, cassettes, DVDs, film or other media. 7 LIMITATIONS TO SERVICE McCurrie Gadgets & PC Services, Inc . shall not be liable for any failure or delay in performance due to any cause beyond its control. Omtat Corporation and/or its third party service providers reserve the right to refrain from providing the Services ordered and instead refund Customer’s payment, wholly or in part, on the basis that the minimum system requirements are not met or the technical needs (including wiring or overcoming physical or technical barriers) or other requirements of the Customer are unusual or extensive and beyond the scope of these Service Terms, as determined by Omtat Corporation. No customer shall be rendered services under the subscription pricing for a pre determined issue/conflict with their PC. The client/Customer will have to pay the full price for the desired service; Upon completion of the service the client can then sign up for a subscription plan, and have all future services rendered, under the subscription pricing as long as their account remains in good standing. INDEMNIFICATION Customer agrees to indemnify, defend, and hold harmless Omtat Corporation . (and its affiliates and their respective officers, directors, employees and agents) from and against any and all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and other expenses, (including but not limited to cost of defense, settlement, and reasonable attorneys’ fees) of whatever type or nature, including, but not limited to, damage or destruction to property, injury (including death) to any person or persons, which are asserted against, incurred, imposed upon or suffered by Omtat Corporation by reason of, or arising from: (a) Customer’s breach of this Agreement; (b) Customer’s actual or alleged infringement of any patent, copyright, trademark, trade secret or other property or contract right of any other person; (c) Customer’s actual or alleged failure to promptly pay sums due Omtat Corporation or third parties; (d) Customer’s failure to comply with applicable laws, regulations or ordinances; or (e) the acts or omissions of Customer (or its officers, directors, employees or agents). DISCLAIMER OF WARRANTIES CUSTOMER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT CUSTOMER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LIMITATION OF LIABILITY Omtat Corporation SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM 8 UNAUTHORIZED ACCESS TO OR ALTERATION OF CUSTOMER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF Omtat Corporation HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO EACH CUSTOMER. It is Customer’s responsibility to back-up the software and data that is stored on Customer’s computers, hard disk drive(s), and/or on any other storage devices Customer may have, and Omtat Corporation shall not be responsible at any time for any loss, alteration, or corruption of any software, data, or files. Omtat Corporation shall not be liable in any way for damages arising from any part, equipment, peripheral, software or other product supplied to Customer by Geek Squad. Notwithstanding any language to the contrary, Omtat Corporation maximum liability to Customer arising from or related to Geek Squad under this Agreement shall be limited to the sums paid by Customer Omtat Corporation under this Agreement during the three months prior to the time the cause of action arose. LAWS These Service Terms shall be governed by and construed in accordance with the laws of the State of Florida, excluding its conflict of law provisions. Customer and Omtat Corporation agree to submit to the Exclusive jurisdiction of the courts in Broward County, Fort Lauderdale, Florida. If any provision(s) of the Agreement is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. Customer and Omtat Corporation agree that any cause of action arising out of or related to this Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.
